Webdeli Websites T&C’s

1. Webdeli will carry out work only where an agreement is provided online or by email with the following refund policy:

  • Full refund: In cases where the project has not been started, or we are unable to meet the initially agreed requirements within the stated timescale, we will provide a full refund.
  • Partial refund: If you feel the work produced does not meet your initial brief a partial refund may be given. This will be the amount paid less the base cost of the time spent on the work.
  • No refunds: If the website has been approved and completed no refund is payable.

2. Websites created by Webdeli are fully hosted by Webdeli and cannot be transferred to another hosted provider within the first 12 months. After the first 12 months period websites can be transferred however the software used by Webdeli will be removed before transfer. Website hosting with Webdeli is not just hosting, it’s part of a package that includes using Webdelis software. Websites domains created can be transferred to a new host. Webdeli cannot accept liability for losses caused by the unavailability, malfunction or interruption of either service, or for loss of turnover, sales, revenue, profits or indirect, consequential or special loss.

3. Should you choose to host your WordPress website on your own hosting service it is your responsibility to transfer the site. You have 30 days to complete the transfer, starting from the date your 12 month hosting package finishes. We advise you to seek support from your new hosting company to facilitate the transfer.

4. Once your site is live on your domain it is assumed that the project has been completed to your satisfaction. Any additional work is then charged at the prevailing support cost.

5. Should you choose the option of having administrative rights to your website you will be able to make changes to your own site and amend content. Webdeli does not accept responsibility for any changes that you make to your site.

6. All text and images submitted must be free of copyright. Webdeli accepts no responsibility for any infringement of copyright law arising from any text or images used on your site. Text needs to be sent in a format that allows us to copy and paste, keeping the existing formatting in place.

7. We may include themes and plugins on your website to improve the overall user experience on your site. These include but are not limited to contact forms, image slideshows, videos and maps. As these are third party softwares created by another supplier we cannot accept responsibility for any loss of service or malfunction that may occur. Each third party reserves the right to alter or remove their service and or charge fees. Customers will be notified in such event and would be able to decide whether or not to continue with the service or to find an alternative provider.

8. We reserve the right to include a screenshot of, and link to your completed website on the portfolio page of our website, review websites, and on any of our social media accounts.

9. All sites can be viewed on laptops, PC’s, tablets and mobile devices running the latest versions of Internet Explorer, Mozilla Firefox, Google Chrome and Safari.

10. Your hosting period begins once your site is live on your domain, or one month after you place your order, or once your domain has been registered (whichever comes first). If you do not make your payments on time the hosting will expire and your site will no longer be live. Once hosting has expired, it will be possible to reinstate your website for a period of 7 days, after 7 days your site will be permanently deleted. Webdeli excludes liability for any loss of profit caused to the customer by the expiration of the hosting as a result of the customer’s failure to renew their services.

11. All domain names will be registered in the clients name and as such the domain name belongs to the client, not to Webdeli. If the customer does not renew the services the domain will expire and will be available for general sale. No cash alternative is available for customers who purchase their own domain name.

12. Webdeli excludes liability for any loss of profit caused to the customer by the expiration of the domain name as a result of a technical fault or any other fault caused by the hosting company or any third party.

14. Website drafts will be created based on the design brief and information provided by the customer. If the design brief changes significantly after the first draft has been created a support charge for any additional work may be applied.

15. If the hosting payment has not been made Webdeli reserve the right to cancel this agreement without notice. All design work carried out will be permanently deleted from our hosting platform and no refund will be payable. Any domains or email accounts that may have been registered will also be cancelled and no refund will be payable.

16. Due to external factors we cannot offer any guarantees regarding the search engine position we will achieve for websites. We cannot accept liability for any change in rankings, or drop off in the position of your website due to changes in the algorithms of the search engines or the factors that they use to rank websites.

17. Webdeli reserve the right to refuse to handle in any way, material which may be deemed offensive, illegal or controversial. We also reserve the right to refuse to handle any site found to be involved in any black hat search engine optimisation techniques. Should any of these situations arise we reserve the right to terminate your web hosting service without notice and you would not be due a refund.

18. Webdeli will complete all websites within 48 hour window from the time all information has been received from the purchaser. If changes are made within the 48 hour window this could delay the completion time and Webdeli will not be responsible for any delays in the website site getting completed. All projects will be created between Monday to Friday 9am – 5pm not including bank holidays and special occasions.

19. All package pay monthly websites subscriptions must be paid on the same day as your first payment date the term agreed when checking, this agreement is to upheld your services not getting restricted. If you miss a payment the website in hand will be disconnected for 30 day’s. If payment is not made within the 30 day period the website will then be deleted from the Webdeli Server and all information will then be deleted. Next payment dates can be found in your Webdeli my account under Subscriptions.

19. We reserve the right to amend the Terms and Conditions at any time.

 

 

Webdeli Local T&C’s

1 Definitions and Acceptance of the Terms and Conditions

  1. Webdeli Local accepts publication of Advertisements (as defined below) on the terms and conditions set out herein (“Terms”).
  2. These Terms apply to:
  • print advertisements in the Webdeli Local as well as inserts;
  • online advertisements webdeli.co.uk (the “Website”); and
  1. By placing an order, the “Advertiser” (which is the person bidding for or placing the order for the Advertisement whether they are the advertiser of the product or service referred to in the Advertisement or the advertising agency or media buyer for such advertiser) accepts and agrees to be bound by these Terms in full.

2 Content and Delivery of Advertisements

  1. Materials for any Advertisement (whether print or digital) must adhere to Webdeli Local’s technical specifications and be delivered to Webdeli Local within the advised time frames. When Webdeli Local builds digital Advertisement units on behalf of the Advertiser, the Advertiser must provide assets.
  2. Webdeli Local may, without any responsibility to the Advertiser, reject, cancel or require any Advertisement to be amended that it considers unsuitable or contrary to these Terms and remove, not print, suspend or change the position of any such Advertisement. Webdeli Local may refuse to publish any Advertisement for any Advertiser who has not paid any sums due for any advertising. The Advertiser will remain responsible for all outstanding charges.
  3. The publication of an Advertisement by Webdeli Local does not mean that Webdeli Local accepts the Advertisement has been provided in accordance with these Terms or that Webdeli Local has waived its rights under these Terms.
  4. The Advertiser guarantees to Webdeli Local that:
  • any information supplied in connection with the Advertisement is accurate, complete, true and not misleading;
  • it has obtained the consent of any living person whose name or image (in whole or in part) is contained in any Advertisement;
  • the Advertisements are legal, decent, honest and truthful, are not contrary to the provisions of any applicable law, regulation or code of practice (including the UK Code of Non-broadcast Advertising, Sales Promotion and Direct Marketing (the “CAP Code”) and all other codes under the general supervision of the Advertising Standards Authority and/or the Office of Fair Trading), are not libelous or obscene and do not infringe the rights of any person (including any person’s intellectual property rights);
  • the Advertisement will not be prejudicial to the image or reputation of Webdeli Local or the Website or the Magazines, and will not contain anything with Webdeli Local in good faith considers to be offensive or otherwise inappropriate;
  • all digital Advertisements submitted for publication online will be free of any viruses, adware, malware, bit torrents, and no Advertisement will cause an adverse effect on the operation of the Website; and
  • all digital Advertisements comply with (i) the the standards for online advertising published by the Coalition for Better Ads (https://www.betterads.org); and (ii) the “L.E.A.N.” best practice principles for online advertising standards published by the IAB UK, each as may be updated from time to time.
  1. Where the Advertiser is an advertising agency or media buyer, the Advertiser guarantees that it is authorised by the advertiser of a product or service to place the Advertisement with Webdeli Local and the Advertiser will compensate Webdeli Local for any claim made by such advertiser against Webdeli Local.

3 Payment

  1. All Advertisements are accepted on the basis that they will be paid for at the prevailing rates set out on the website before advertising. Webdeli Local may change its rates at any time by publishing the modified rates. Any changes to the rates will take effect immediately. However, any changes to the applicable rates will not apply to any orders made prior to the date of such change.
  2. All sums payable to Webdeli Local should be made in accordance with Webdeli Local’s Terms & Conditions which are: Webdeli Local will provide services only on a pre-payment basis, with receipt of cleared funds prior to the booking being confirmed.

4 Online Advertisements

  1. The Advertiser guarantees to Webdeli Local that any landing page and/or destination site linked to from the Advertisements (“Advertiser’s Site”) will (i) be legal, decent, honest and truthful, (ii) not be contrary to the provisions of any applicable law, regulation or code of practice (including the CAP Code), (iii) not be libelous or obscene, (iv) not infringe the rights of any person (including any person’s intellectual property rights); (v) not be prejudicial to the image or reputation of Webdeli  the Website or the A4 Flyers; (vi) be free from viruses, adware, malware, and/or bit torrents, (vii) not cause an adverse effect on the operation of the Website, and (viii) have a conspicuous privacy policy which complies with all applicable data protection and privacy laws, regulations and codes of practice.
  2. To the extent that Webdeli Local sets cookies on the devices of users of the Advertiser’s Site(s) or uses any other data collecting technology (such as pixels, tags, javascript, or other code, including the tags of third party service providers) for the purpose of tracking impressions and related data (“Advertiser Data”), Advertiser shall ensure that it has a lawful basis for the use of such data collecting technology and the collection of Advertiser Data from visitors to the Advertisers Site(s) and that the Advertiser and the Advertiser’s Site complies with all applicable data protection and/or privacy laws, regulations and codes of practice.
  3. Webdeli Local and its service providers will only use any Advertiser Data solely in relation to the Advertiser’s particular advertising campaign. All such Advertiser Data collected by Webdeli Local will be treated as the confidential information of the Advertiser and will not be disclosed by Webdeli Local to any third party (other than Webdeli Local’s service providers for the purpose of Webdeli Local complying with its obligations under these Terms) without the consent of the Advertiser. In no event will any Advertiser Data be combined with information collected from other sources, except where the Advertiser has agreed otherwise.

5 Inserts

  1. Occasionally, Webdeli Local cannot distribute the number of Inserts agreed with the Advertiser due to changes in the print run. Where this happens, Webdeli Local will distribute all ‘overs’ at the next suitable opportunity. The Advertiser will be liable for the full cost of the Insert order. In no event will Webdeli Local be liable for loss arising from failure to insert or any errors in the insertion of Inserts

6 Liability of Webdeli

  1. Webdeli Local accepts no responsibility for any interruption or delay the Advertiser experiences in delivering any Advertisement copy to Webdeli Local or any loss or damage to any Advertisement copy or any other materials. The Advertiser guarantees that it has retained sufficient quality and quantity of all materials supplied to Webdeli Local.
  2. Webdeli Local shall use its reasonable endeavors to reproduce Advertisements as provided by the Advertiser but cannot guarantee that the Advertisement will be of the same quality.
  3. Webdeli Local will not be responsible for any additions to, changes in, deletions from, delays in publication or withdrawal of any Advertisements required by any authority having responsibility for the regulation of online or press advertising (including the Advertising Standards Authority).
  4. Webdeli Local cannot guarantee the time, dates and/or position of Advertisements and all such decisions will be at the sole discretion of Webdeli Local. However, Webdeli Local will use reasonable efforts to comply with the wishes of the Advertiser.
  5. If a booked Advertisement is not published at all solely due to a mistake on Webdeli Local’s part, Webdeli Local will try to offer an alternative publication date(s). If the alternative date(s) is not accepted, the original booking will be cancelled and the Advertiser shall be entitled to a full refund if the Advertiser has paid in advance for the Advertisement. This shall be the Advertiser’s sole remedy for failure to publish the advertisement.
  6. If the Advertisement as reproduced by Webdeli Local contains a substantial error solely due to a mistake on Webdeli Local’s part, Webdeli Local shall, on request, re-publish the Advertisement at no additional cost to the Advertiser. Webdeli Local shall not be responsible for repetition of errors and it is the Advertiser’s responsibility to inform Webdeli Local of any errors and provide any necessary assistance to Webdeli Local to prevent a repeat of the error.
  7. Webdeli Local shall not be responsible, under any circumstances, for any loss of profit, loss of opportunity, loss of goodwill, loss of anticipated saving, loss of revenue and/or any other loss which happens as a side effect of the main loss suffered by the Advertiser or any loss which could not be contemplated by Webdeli Local and the Advertiser, and Webdeli Local’s maximum total liability for any loss or damage arising out of or in relation to any Advertisement whether in contract, tort or otherwise shall not exceed the total amount of the charges for the relevant Advertisement actually paid by or on behalf of the Advertiser.
  8. In respect of Advertisements on the Website, Webdeli Local does not guarantee continuous, uninterrupted access by users of the Website but will use reasonable efforts to provide this). In addition, Webdeli Local will not be responsible for any failure or delay affecting production or publication of any Magazine or the transmission of the Website and any Advertisements contained in them, in any manner where such failure or delay results from any act, omission, interruption, fault or other condition beyond the reasonable control of Webdeli Local.
  9. For the avoidance of doubt, nothing in these Terms will limit or exclude Webdeli Local’s responsibility for death or personal injury resulting from its own negligence, fraud or any other liability that cannot be excluded.
  10. Nothing in these terms and conditions shall affect the statutory rights of an Advertiser who is a consumer.

7 Liability of the Advertiser

  1. The Advertiser will fully indemnify Webdeli Local from all investigations, claims, fines, losses, damages, costs (including reasonable legal fees) expenses and liabilities arising as a result of any breach or failure to comply with any of these Terms and/or the use or publication of the Advertisement by Webdeli Local in accordance with these Terms.

8 Rights

  1. Webdeli Local owns the copyright in all Advertisements written or designed by it or on its behalf.
  2. The Advertiser grants Webdeli Local the right (free of charge) to:
  • use such of the Advertiser’s names, trade marks and/or logos as Webdeli Local may consider necessary for the purposes of publishing the Advertisements;
  • reproduce the Advertisement in any media at any time from the date the Advertisement was last published in the A4 Flyer for promotional purposes. For the avoidance of doubt, the content, layout and format of any Website or Magazine will be subject to variation at Webdeli Local’s sole discretion.

9 Cancellation policy

  1. The cancellation period for an Advertisement varies according to the publication. Advertiser may cancel an Advertisement provided that notice in writing is received by Webdeli Local within the relevant cancellation period. In respect of Advertisements on the Website, the minimum notice period for cancellation by the Advertiser is 30 days unless agreed otherwise. Please send notice of your intention to cancel to the person who made your booking. Cancellation will only be effective on confirmation of receipt of your notice.
  2. If the Advertiser is insolvent or bankrupt or is otherwise in breach of these Terms, Webdeli Local may treat the order as cancelled.

10 General

  1. A person who is not a party to these Terms has no rights to rely upon or enforce any of these Terms.
  2. If Webdeli Local fails or delays in exercising its rights or remedies provided by these Terms, it shall not be deemed to have waived that or any other right or remedy under these Terms.
  3. Nothing in these Terms shall be deemed to constitute a relationship of principal and agent, a partnership, joint-venture, or co-ownership. Neither party shall have the authority to act for, bind or otherwise create or assume any obligation on behalf of the other, and neither party shall hold itself out as having authority to do the same.
  4. These Terms are the entire agreement between the Advertiser and Webdeli Local in respect of the Advertisements and no modification to these Terms will be effective unless made in writing and signed by both Webdeli Local and the Advertiser.
  5. These Terms and any documents referred to and therefore incorporated by reference herein shall apply to the exclusion of all other terms and conditions which the Advertiser purports to apply to the purchase of Advertisements (including, without limitation, terms in any insertion or purchase order, e-mail, acknowledgement or click through agreement). To the maximum extent permitted by law, other than as set out in these Terms, all warranties and representations, whether express or implied, are excluded.
  6. Subject to clause 24, these Terms (and any non-contractual obligations arising in connection with them) shall be governed by English law and the courts of England and Wales will have exclusive jurisdiction in relation to these Terms (and any non-contractual obligations arising in connection with them).

Webdeli Classified T&C’s

At Webdeli Classified, we strive to maintain a clean, friendly, and user-friendly platform for everyone. Ads that do not adhere to our posting guidelines found in the Help sections or our Terms of Use may be removed. You are responsible for all information submitted and any consequences that arise from your posting. We reserve the right to delete or refuse content that we deem inappropriate or in violation of our Terms of Use, and we may restrict user access temporarily or permanently, or deny user registrations. Before posting, please remember that ads must be submitted by members over 16 years old, malicious or defamatory ads are prohibited, illegal items or services are not allowed, adult content is forbidden, personal ads cannot be posted, and all ads must be listed in the correct category. Each item, job, or service may only be posted once and must consist of a single item, except for household clearance ads and job listings for multiple openings. All items for sale must state their price, URLs should be placed in the designated field instead of the ad description, and contact details must be entered correctly without revealing them in the description or title. Premium phone numbers should only appear in the Registered Phone Number field, while fake or invalid numbers are not acceptable. Keyword spamming is prohibited, and we do not tolerate any form of discrimination or the use of offensive language. Auction ads are not allowed, and any sold items or unavailable ads should be deleted by the poster. All items and services must originate from the UK. Ads stating that cash will not be accepted or that items cannot be inspected in person are not allowed. Pre-order ads are also prohibited, as all items must be in the seller’s possession prior to posting. Ads should be in English, although translations are permissible. We reserve the right to remove any listings that contain inaccuracies, false claims, misleading information, or exploit vulnerable users.
Using Webdeli
As a condition of your use of Webdeli Classified you agree that you will not:
  • violate any laws;
  • violate the Policies;
  • post any threatening, abusive, defamatory, obscene or indecent material;
  • post or otherwise communicate any false or misleading material or message of any kind;
  • infringe any third-party right;
  • distribute spam, chain letters, or promote pyramid schemes;
  • distribute viruses or any other technologies that may harm Webdeli Classified or the interests or property of Webdeli Classified users;
  • impose or contribute to imposing an unreasonable load on our infrastructure or interfere with the proper working of Webdeli Classified;
  • copy, modify, or distribute any other person’s content without their consent;
  • use any robot spider, scraper or other automated means to access Webdeli Classified and collect content for any purpose without our express written permission;
  • harvest or otherwise collect information about others, including email addresses, without their consent;
  • copy, modify or distribute rights or content from Webdeli Classified or Webdeli Classified copyrights and trademarks;
  • harvest or otherwise collect information about users, including email addresses, without their consent;
  • bypass measures used to prevent or restrict access to Webdeli Classified;
  • use any tool that interferes with the normal functioning of Webdeli Classified, including, without limitation, browser plug-ins (including, but not limited to, FreeTheTree), extensions, or other software which are designed to supplement, remove or otherwise change any of Webdeli Classified functionalities; or
  • sell any counterfeit items or otherwise infringe the copyright, trademark or other rights of third parties.
You are solely responsible for all information that you submit to Webdeli Classified and any consequences that may result from your post. We reserve the right at our discretion to refuse or delete content that we believe is inappropriate or breaching the above terms. We also reserve the right at our discretion to restrict a user’s usage of Webdeli Classified either temporarily or permanently, or refuse a user’s registration. If we believe that you are breaching these Terms of Use in any way and/or behaving suspiciously on Webdeli Classified, we may, at our discretion, inform other Webdeli Classified users that have been in contact with you and recommend that they exercise caution.
Abusing Webdeli
Webdeli Classified and the Webdeli Classified community work together to keep Webdeli Classified working properly and the community safe. Please report problems, offensive content and policy breaches to us using the reporting system.
Without limiting other remedies, we may issue warnings, limit or terminate our service, remove hosted content and take technical and legal steps to keep users off Webdeli Classified if we think that they are creating problems, infringing the rights of third parties or acting inconsistently with the letter or spirit of our policies (including, without limitation, circumventing temporary or permanent suspensions or harassing the Webdeli Classified employees or other users). However, whether we decide to take any of these steps, remove hosted content or keep a user off Webdeli Classified or not, we do not have any obligation to monitor the information transmitted or stored on Webdeli Classified and we do not accept any liability for unauthorised or unlawful content on Webdeli Classified or use of Webdeli Classified by users.
Fees and Services
Using Webdeli Classified is generally free, but we sometimes charge a fee for certain services. If the service you use incurs a fee, you’ll be able to review and accept terms that will be clearly disclosed at the time you post your ad. Our fees are quoted in Pounds Sterling, and we may change them from time to time. We’ll notify you of changes to our fee policy by posting such changes on Webdeli Classified. We may choose to temporarily change our fees for promotional events or new services; these changes are effective when we announce the promotional event or new service.
You are responsible for paying the Webdeli Classified fees when they’re due. If you don’t, without prejudice to any other right or remedy we may be entitled to under these Terms of Use or by law, we may limit your ability to use the services. If your payment method fails or your account is past due, we may collect fees owed using other collection mechanisms.
You acknowledge that your ads may be deleted from Webdeli Classified in case we believe these Terms of Use, including our Posting Rules, are breached, either directly or indirectly. In case you would have paid a fee for the display of such ad, you may be entitled to a refund of such fee. However, we reserve the right not to refund Webdeli Classified users for any fees paid through use of Webdeli Classified in the following cases:
  • If you breach, in our opinion, these Terms of Use, which include, without limitation, the Policies;
  • If your ads went live with exposure on the Webdeli Classified sites, services, applications or tools, even for a limited time, and that they benefited from the service associated with the paid fee;
  • If your ads are placed in the Pets or Massage categories of Webdeli Classified;
  • If your ads are placed into “edit” mode and will go live to site once updated by you;
  • If you have removed your ads yourself;
  • If you post duplicate ads as defined in our rules regarding duplicate ads;
  • If we believe that your ads are in a significantly wrong category;
  • Please note that the above list is not exhaustive.
In addition to the Webdeli Classified services, ancillary goods or services such as insurance or car finance may be advertised on Webdeli Classified. Although users may offer financial products on their ads, Webdeli Classified is in no way involved or liable for any loss related to such transactions.
Display and placement of user ads
We strive to create a community where users can find what they are looking for. Therefore, the appearance or placement of ads in search and browse results will depend on a variety of factors, including, but not limited to:
  • users’ location and search query / category selected;
  • adverts’ category, content, location and date published;
Content
Webdeli Classified contains content from us, you, and other users. Webdeli Classified is protected by copyright laws and international treaties. Content displayed on or via Webdeli Classified is protected as a collective work and/or compilation, pursuant to copyrights laws and international conventions. You agree not to copy, distribute or modify content from Webdeli Classified without our express written consent. You may not disassemble or decompile, reverse engineer or otherwise attempt to discover any source code contained in Webdeli Classified. Without limiting the foregoing, you agree not to reproduce, copy, sell, resell, or exploit for any purposes any aspect of Webdeli Classified (other than your own content). When you give us content, you grant us and represent that you have the right to grant us, a non-exclusive, worldwide, perpetual, irrevocable, royalty-free, sub-licensable (through multiple tiers) right to exercise any and all copyright, publicity, trademarks, design, database and intellectual property rights to that content, in any media whether now known or to be discovered in the future including, without limitation, on any third party Platforms and media channels. In particular, by giving us content, you grant us the right to display such content and on other online marketplaces, social media channels, blogs, in all types of marketing communications and on all other Platforms. In addition, you waive all moral rights you have in the content to the fullest extent permitted by law.
Webdeli Classified may at times use third party data suppliers to supplement the information you have provided in an ad. This could include descriptions, product specifications and other content. You may use such information solely in connection with your Webdeli Classified ad while your ad is on Webdeli Classified. The information provided may be subject to copyright, trademark and/or other protections. You agree not to remove any such protected information and/or create any derivative works based on the content (other than by including them in your ads).This permission is subject to modification or revocation at any time at Webdeli Classified sole discretion.
You may not have the opportunity to review all of the supplemental data before posting an ad. Webdeli Classified is not responsible for the accuracy of any third party supplied supplemental data. You continue to be responsible for ensuring that your ads are accurate, do not include misleading information and fully comply with these Terms of Use and all Webdeli Classified policies. If you notice inaccuracies in this data after your ad appears on the site please get in touch with us.
Infringement
Do not post content that infringes the rights of third parties. This includes, but is not limited to, content that infringes on intellectual property rights such as copyright, design and trademark (e.g. offering counterfeit items for sale). A large number of products of all sorts are offered on Webdeli Classified by private individuals. Entitled parties, in particular owners of copyright, trademark rights or other rights can report any advertisement which may infringe on their rights, and submit a request for such advertisement to be removed. If a legal representative of the entitled party reports this to us in the correct manner, products infringing on the intellectual property rights will be removed by Webdeli Classified.
Reporting an infringement:
In order to participate in the Notice of Infringement Programme, you only need to complete a Notice of Infringement Form and email it to Webdeli Classified at classified@webdeli.co.uk. You can use this form, complete with your signature, to report advertisements which may infringe on your property rights. The information requested in the Notice of Infringement Form is for the purpose of ensuring that the parties reporting these objects are either the entitled party or their officially authorised representative. This information must also enable Webdeli Classified to identify the advertisement to be removed. Once we have received your correctly completed Notice of Infringement Form, you can simply send later reports to Webdeli Classified via the e-mail address provided.
Note: This form can only be used by the lawful owners of the relevant intellectual property rights. The “Notice of Infringement” is intended to enable rights owners to ensure that products offered by Webdeli Classified users do not infringe their copyright, trademark rights or other intellectual property rights. Financial Products
Webdeli Classified operates solely as an introducer for the financial products advertised on this website (which includes unsecured loans and insurance). We do not provide any advice or give any opinions on the merits of any of the financial products that we advertise and users are advised to conduct their own research and seek independent financial advice before applying for any of these financial products.
Liability
Nothing in these terms shall limit our liability for fraudulent misrepresentation, or for death or personal injury resulting from our negligence or the negligence of our agents or employees. You agree not to hold us responsible for things other users post or do.
We do not review users’ postings and are not involved in the actual transactions between users. As most of the content on Webdeli Classified comes from other users, we do not guarantee the accuracy of postings or user communications or the quality, safety, or legality of what’s offered.
In no event do we accept liability of any description for the posting of any unlawful, threatening, abusive, defamatory, obscene or indecent information, or material of any kind which violates or infringes upon the rights of any other person, including without limitation any transmissions constituting or encouraging conduct that would constitute a criminal offence, give rise to civil liability or otherwise violate any applicable law.
You acknowledge that we cannot guarantee continuous, error-free or secure access to our services or that defects in the service will be corrected. While we will use reasonable efforts to maintain an uninterrupted service, we cannot guarantee this and we do not give any promises or warranties (whether express or implied) about the operation and availability of our sites, services, applications or tools.
Accordingly, to the extent legally permitted we expressly disclaim all warranties, representations and conditions, express or implied, including those of quality, merchantability, merchantable quality, durability, fitness for a particular purpose and those arising by statute. We are not liable for any loss, whether of money (including profit), goodwill, or reputation, or any special, indirect, or consequential damages arising out of your use of, or inability to use Webdeli Classified, even if you advise us or we could reasonably foresee the possibility of any such damage occurring. Some jurisdictions do not allow the disclaimer of warranties or exclusion of damages, so such disclaimers and exclusions may not apply to you. Despite the previous paragraph, if we are found to be liable, our liability to you or any third party (whether in contract, tort, negligence, strict liability in tort, by statute or otherwise) is limited to the greater of (a) the total fees you paid to us in the 12 months prior to the action giving rise to liability, and (b) 100 Pounds Sterling.
Release
If you have a dispute with one or more Webdeli Classified users, you release us (and our officers, directors, agents, subsidiaries, joint ventures and employees) from any and all claims, demands and damages (actual and consequential) of every kind and nature, known or unknown, arising out of or in any way connected with such disputes.
Third party rights
A person who is not a party to this Agreement has no right under the Contracts (Rights of Third Parties) Act 1999 to enforce any Terms of Use but this does not affect any right or remedy of a third party specified in this Agreement or which exists or is available apart from that Act.
Data Protection and Privacy
By using Webdeli Classified, you agree to the collection, transfer, storage and use of your personal information by Webdeli Classified.
You and Webdeli Classified shall process personal data received under and/or in connection with these Terms of Use each as a separate and independent controller. In no event will Webdeli Classified and you process personal data under and/or in connection with this User Agreement as joint controllers or in a controller-to-processor relationship. As such separate and independent controllers, you shall be individually and separately responsible for complying with the obligations that apply to you as a controller under applicable data protection law.
You shall comply with your obligations under applicable data protection law (including but not limited to the Regulation (EU) 2016/679 (EU General Data Protection Regulation “GDPR”)) and supplementing EU and local data protection law. This includes, but is not limited to the obligation to provide appropriate safeguards for the transfer of personal data to a third country or an international organisation. You shall process personal data received from Webdeli Classified exclusively for the purpose(s) you received the personal data under and/or in connection with these Terms of Use. You shall erase the personal data received under these Terms of Use immediately after the respective purpose(s) has/have been fulfilled. Any further processing of the personal data is not permitted except when legally required (e.g., if a retention obligation applies).
Failure to abide with the aforementioned obligations may result in disciplinary action up to and including account suspension.
As part of the services, Webdeli Classified has access to various information about users, including personal data. This includes information that users submit to Webdeli Classified as part of the services (such as contact information or item descriptions) as well as information that is generated by the provision and processing of the services (such as ratings, sales analysis or communication).
Via Webdeli Classified and its related websites, services, applications or tools, you receive information which is necessary for the processing of transactions (in particular, the contact information of the other user involved in a transaction) as well as aggregated information on the performance and analysis of your ads, which are partly related to the data of other users of the services (such as number of impressions of an ad, conversion rate or return rate).
Webdeli Classified only shares information about users with third parties if this is necessary for the provision of the services or if Webdeli Classified is legally or contractually entitled to do so.
Upon expiry of these Terms of Use, we will delete the information you provided, or which was generated through your use of the services from your Webdeli Classified account. Regardless, we maintain this information after the expiry of these Terms of Use if we are legally obliged or have a legitimate interest to do so. We will generally maintain aggregated data generated using the services (e.g. statistics about ads in a category) upon expiry of these Terms of Use.

Resolution of disputes
If a dispute arises between you and Webdeli Classified, we strongly encourage you to first contact us directly to seek a resolution by going to the Webdeli Classified Contact page. We will consider reasonable requests to resolve the dispute through alternative dispute resolution procedures, such as mediation or arbitration, as alternatives to litigation.
General
These terms and the other policies posted on Webdeli Classified constitute the entire agreement between Webdeli Classified and you, superseding any prior agreements. No agency, partnership, joint venture, employee-employer or franchiser-franchisee relationship is intended or created by this Agreement.
This Agreement shall be governed and construed in all respects by the laws of England and Wales. You agree that any claim or dispute you may have against Webdeli Classified must be resolved by the courts of England and Wales. You and Webdeli Classified both agree to submit to the non-exclusive jurisdiction of the English Courts; for claims falling within the jurisdiction of a County Court, you and Webdeli Classified both agree to submit to the jurisdiction of the County Court.
If we don’t enforce any particular provision, we are not waiving our right to do so later. If a court strikes down any of these terms, the remaining terms will survive. We may automatically assign this agreement in our sole discretion in accordance with the notice provision below.
We may update this agreement at any time, with updates taking effect when you next post or 30 days after we post the updated policy on the Webdeli Classified website, whichever is sooner. No other amendment to this agreement will be effective unless made in writing, signed by users and by us.
Mobile Devices Terms
If you’re accessing Webdeli Classified Services from a mobile device using a Webdeli Classified Mobile Application (the “Application”), the following terms and conditions (“Terms of Use”) apply to you in addition to the applicable Mobile Privacy and Legal Notice or End User License Agreement, as the case may be. Your use of the Application confirms your agreement to these Terms of Use.
Application Use. Webdeli Classified grants you the right to use the Application only for your personal use. You must comply with all applicable laws and third party terms of agreement when using the Application (e.g. your wireless data service agreement). The Application may not contain the same functionality available on the Webdeli Classified website. Your download and use of the Application is at your own discretion and risk, and you are solely responsible for any damages to your hardware device(s) or loss of data that results from the download or use of the Application.
Intellectual Property – Applications. Webdeli Classified owns, or is the licensee to, all right, title, and interest in and to its Applications, including all rights under patent, copyright, trade secret, trademark, and any and all other proprietary rights, including all applications, renewals, extensions, and restorations thereof. You will not modify, adapt, translate, prepare derivative works from, decompile, reverse-engineer, disassemble, or otherwise attempt to derive source code from any Application and you will not remove, obscure, or alter Webdeli Classified copyright notice, trademarks or other proprietary rights notices affixed to, contained within, or accessed in conjunction with or by any Webdeli Classified Application.
Additional Terms. Additional terms and conditions that apply to you based on the mobile device the Application is installed on:
iOS – Apple
  1. These Terms of Use are an agreement between you and Webdeli Classified, and not with Apple. Apple is not responsible for the Application and the content thereof.
  2. Webdeli Classified grants you the right to use the Application only on an iOS product that you own or control and as permitted by the Usage Rules set forth in the App Store Terms of Service.
  3. Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the Application.
  4. Apple is not responsible for the investigation, defense, settlement, and discharge of any third party intellectual property infringement claim.
  5. Apple is not responsible for addressing any claims by you or any third party relating to the Application or your possession and/or use of the Application, including but not limited to: (a) product liability claims; (b) any claim that the Application fails to conform to any applicable legal or regulatory requirement; and (c) claims arising under consumer protection or similar legislation.
  6. In the event of any failure of the Application to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if applicable, for the Application to you; and to the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the Application.
  7. Apple and Apple’s subsidiaries are third party beneficiaries of these Terms of Use, and, upon your acceptance, Apple as a third party beneficiary thereof will have the right (and will be deemed to have accepted the right) to enforce these Terms of Use against you.
Windows – Microsoft
  1. These Terms of Use are an agreement between you and Webdeli Classified, not Microsoft. The terms of use and privacy policies of Microsoft and, where applicable, the network operators that provide billing services for the Windows Phone Marketplace do not apply to your use of the Application.
  2. You may install and use one (1) copy of the Application on up to five (5) devices you personally own or control and which are affiliated with the Windows Live ID associated with your Windows Marketplace account. You may not install or use a copy of the Application on a device you do not own or control.
  3. Microsoft, your device manufacturer, and (if applicable) your wireless carrier are not responsible for providing support services for the Application.
  4. Microsoft, the wireless carriers over whose network the Application is distributed (if applicable), and each of their respective affiliates and suppliers (collectively, “Disclaiming Distributors”) give no express warranty, guarantee, or conditions under or in relation to the Application. To the extent permitted under your local laws, the Disclaiming Distributors exclude any implied warranties or conditions, including those of merchantability, fitness for a particular purpose, and non-infringement.
  5. You, and not the Disclaiming Distributors, bear the risk of using the Application (even if the Disclaiming Distributors have been advised of the possibility of damages to you). You may have additional consumer rights under your local laws which these Terms of Use cannot change.
  6. To the extent not prohibited by law, you will not seek to recover any consequential, lost profit, special, indirect, or incidental damages from any Disclaiming Distributor.
